I have a situation where the copule stated their past landlord was going to throw them and their children out in the street. I allowed them to move in in the middle of a month and they promised to pay on a certain day , the rent and the deposit. They signed a years lease. Todate, they have paid nothing, and that is going on two months now. They won't put the utilities in their name and I am told I can't turn the utilities off. So not only are they living free in my home but they are using my utilities as well. It is a nightmare. I have issued an eviction notice and have a court date but these people say they know their right and it looksl ike this could go for some time. what to do?????????

Q: I had been communicating with a landlord about signing a lease. On Friday 4/2/10 it was agreed that we would meet on the following Tuesday (4/6) to sign the lease and pay the deposit since I was out of town for the holiday weekend. In the meantime, I'm guessing Monday she had let another tennant sign and now has canceled our appointment. Is this allowed or just really shady business practices?

My lease expired in December 2009; in January 2010 my landlord informed me he "may be losing the home, had a buyer but wanted to give me the option since I had been a good tenant"; however didn't tell me he filed bankruptcy in April 2009 and probably hadn't been paying his mortgage ever since because the home is currently in foreclosure. I 'm in the process of buying my own home but want to know if I have any refund rights since I've honored the lease by paying my rent on time and he hasn't been paying his mortgage. Can he evict me ASAP? We're not on a lease now and I need my rent money to cover expenses with purchasing my new home, etc. I gave him 2 months security deposit, plan on moving the end of this month (March 2010) and don't expect the extra month refunded to me.

My daughter moved out of a house she shared with another girl. The other girl was a friend of the landlords family. She moved out before the lease expired, so the landlord deducted all additional charges from my daughters half of the deposit. Her landlord charged her for lightbulbs, a smoke detector, and for carpet cleaning. We had the carpets professionally cleaned because she agreed to do that in the pet addendum, but he said it was never done, even though we have the bill and cancelled check. Any advice on what the law states on this, as we are suing him in small claims court.
